STARLYNGS
— TERMS OF SERVICE AND USE —
To own a Starlyng, Oort, or Boötes, you must agree to the following terms. Breaking rules will result in warnings or a ban from the community depending on the severity of the offense. Banned users will be listed publicly on a blacklist, and users will be recommended to not do business with them. Bans will never revoke ownership of a banned user’s Starlyngs, Oort, and Boötes, but they will no longer be eligible to create or buy these species.

GENERAL SPECIES RULES
#01: Starlyngs, Oort, and Boötes need to be on the Masterlist to be considered official.
- Unofficial Starlyngs, Oort, and Boötes may be posted in the server or on other websites such as Toyhou.se, but you may NOT list them as “Starlyngs”, "Oort", or "Boötes" unless they are approved.
- Likewise, “off-brand” versions of these species are permitted, as long as they are not stated to be Starlyngs. However, please do not post them in the community unless you are planning on making them official out of respect. Additionally, please do not sell "off-brand" adoptables with the intent of having the buyer approve the designs at a later date.
#02: All Starlyngs, Oort, and Boötes have a cooldown of two weeks after approval or obtaining them before being able to be transferred to another user. All transfers must be done through Starlyng.space.
- Trade listings for characters on cooldown will be deleted. The cooldown period for ownership transfers is TWO WEEKS after obtaining a design.
- Excepting swap events, cooldowns are only removable if a design is explicitly bought for another user during a purchase OR if a design is being gifted.
- If a design is being purchased for another user, it needs to be disclosed during the purchase and transferred to the recipient or it will be subject to normal cooldowns.
#03: Approved MYO Starlyngs, Oort, and Boötes may not be sold for real-world money unless they were created with a Paid MYO, or have had other Paid Items applied to them. However, you may sell them freely for Stardust, or trade and gift them to other users.
- A MYO's eligibility to be resold and dollar value from any Paid Items applied to it will be listed next to their status on their Masterlist page.
- Price gouging is not permitted; resellable MYOs may not be resold for significantly more than the combined value of their additional artwork and base resell value.
- If an unsellable Starlyng is an alternate form of an existing, non-Starlyng character before being approved, the original design may still be sold. This original form may not be advertised for sale in our community, and the Starlyng form itself cannot have a resale value listed.
#04: Obtained Items may not be sold for real-world money unless they are Paid Items. However, they may be sold for their equivalent value or lesser in Stardust, or be traded and gifted to other users.
- Free monthly MYOs are not Items and do not stack from month-to-month, nor can they be transferred from user-to-user. Do not post ads for or attempt to exchange these.
- Account-bound (AB) Items cannot be transferred from user-to-user. Do not post ads for or attempt to exchange these.
- Paid Items may only be obtained through purchases at the Vermyllion Pavilion and Starlyngs Ko-fi Shop. Only these may be resold for their equivalent value or lesser in real-world money.
- Price gouging Items is not permitted; ads attempting to exchange Items far beyond their intended values will be taken down.
#05: Only Official Artists and Guest Artists may sell Starlyng, Oort, or Boötes adoptables/official customs.
- Customs created by Official Artists and Guest Artists are automatically made official. They do not require any additional Items provided by the client.
- Normal users may offer commissions to create unofficial customs for other users. You may not include your own MYOs or Items in these custom commissions; they must be provided by the client. These Starlyngs, Oort, or Boötes will not be considered official until they are approved and listed on the Masterlist.
#06: Starlyngs, Oort, and Boötes that were originally obtained as adoptables and customs from Official Artists and Guest Artists may be resold for real money.
- A character's eligibility to be resold and dollar value at purchase will be listed next to their status on their Masterlist page.
- Price gouging is not permitted; resellable characters may not be resold for significantly more than the combined value of their additional artwork and base resell value.
- Official and Guest designs that were originally raffles, gifts, or trades may not be resold.
#07: Starlyngs, Oort, and Boötes may not be depicted in a NSFW manner in any circumstances. Do not create pornographic or otherwise sexual content with them.
#08: Starlyngs, Oort, and Boötes may not be used in commercial works. Do not sell merchandise featuring these characters.
#09: Starlyngs, Oort, and Boötes may be voided by their owners via the Void and Unvoid Prompt if you wish to disconnect them from the species. They will no longer be considered official Starlyngs, Oort, or Boötes, and should not be listed as such. However, their Masterlist entries will remain and be held by grimshaw.
- If you own a voided character, you may request to make them official again using the same Prompt.
#10: Starlyngs, Oort, and Boötes can be depicted in ways that are not accurate to the lore or their designs on the Masterlist, but should still adhere to the rules.
- Prompt submissions that depict Starlyngs, Oort, or Boötes with Traits that they DO NOT have access to on the Masterlist are subject to being denied unless it is clear that they are imaginary.

DESIGN RULES
#11: A Starlyng, Oort, or Boötes' design may not contain anything offensive, culturally appropriative, or NSFW. Bans may be issued if such designs are attempted to be submitted.
#12: Starlyngs, Oort, and Boötes may be inspired by preexisting characters and media, but must be credited accordingly. 1-to-1 copies are not permitted; character-based-characters (CBCs) must have noticeable differences from the character being referenced.
- Characters based on real people (including their avatars, such as VTuber models, or fictional variations, as in F/GO) are not allowed. CBCs may be denied if their inspiration is offensive or controversial.
#13: PLAGIARISM IS NOT TOLERATED. Taking recognizable inspiration from other Userlyngs' works without their express permission and proper accreditation is not allowed. Confirmed instances of this will result in a warning; further action will be taken based on the severity of the offense.
- This also applies to any creator that can feasibly be contacted for their consent within the Starlyng community or otherwise.
- Claims of plagiarism will be thoroughly investigated and verified. We will not reprimand users on baseless accusations.
- Please contact us if you suspect this has happened to you. Be aware that we will prioritize recent instances of plagiarism involving Starlyngs; past instances may not be reprimandable.
#14: Redesigns are approved on a case-by-case basis, but will never require items to be made. There are no specific rules for redesigns, but they must be reminiscent of their original design. Respect the original artist’s intentions with your redesigns.
- Traits may be exchanged for Traits of the same Rarity in a redesign.
- Traits may be removed if desired.
- Please note that additional Uncommon, Rare, Legendary, and Mythical Traits will typically require Items to add.
- If a Starlyng's Rarity is listed as Uncommon, Rare, or Mythical, Traits within and lower than the Rarity it is marked as may be freely added in a redesign.
- A redesign of a Starlyng, Oort, or Boötes may not be "split" from its original design and repurposed into an entirely new character for any reason. The only exception to this rule is for Binary Starlyngs that are owned and designed by the user attempting to split them. The split Unary Starlyng will require an MYO and Trait Items to be resubmitted.
#15: Starlyngs, Oort, and Boötes may have alternate designs; please note that only one Alternate Form and one Alternate Palette will be uploaded to the Masterlist, and that these cannot be "split" or separated from the character they are associated with.
#16: One-off versions of Starlyngs, Oort, and Boötes may be freely made, but should not be separated from their Starlyng, Oort, or Boötes form.
- We do not regulate what you can do with the one-off version of your characters. For example, you may sell merchandise of one-off versions of them if desired.

#17: You must be at least 13 years of age to participate in our community. If users are discovered to be under 13, they will not be permitted to engage with the community until they are 13. These users’ preexisting Starlyngs, Oort, and Boötes will not be revoked.
- Consequently, please respect that this is a 13+ community. Keep all discussions and language PG-13.
#18: Blocking Stafflyngs is a bannable offense. If you have any concerns, please file a ticket.
#19: Dropping out of sales without any prior communication is a bannable offense. If you have any concerns or this has happened to you, please file a ticket.
#20: Do not harass or bully users under any circumstance. Be kind to others. Warnings will be issued for rudeness and passive aggression. If another user has broken the rules or has previously exhibited alarming behavior, please contact a moderator to resolve the situation for you.
#21: Do not vent excessively or trauma dump; keep heavy topics to a minimum. Oversharing is generally discouraged; warnings will be privately issued if deemed necessary.
#22: Do not post rapidly flashing videos or GIFs without a spoiler and proper tagging.
#23: Do not promote, discuss, or share hate speech or bigotry of any kind. Racism, slurs, antisemitism, xenophobia, cultural insensitivity/appropriation, ableism, sexism, transphobia, and homophobia will not be tolerated under any circumstance and will result in warnings or a ban.
#24: Do not promote, discuss, or share NSFW content in the Starlyng Discord server, Toyhou.se world, or on the Lorekeeper.
- Additionally, do not not promote, discuss, or share illegal or otherwise immoral interests. This includes pedophilia, bestiality/feral NSFW, noncon, incest, or “proshipping”/”pro-fiction”. This will result in an immediate ban.
